End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Jonathan Gafner ("Licensor") for the use of the JetWings IntelliJ IDE plugin, mobile application, desktop application, and web client (collectively, the "Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.

1. License Grant​

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the Software for your personal or internal business purposes
  • Install the IntelliJ IDE plugin via the JetBrains Marketplace
  • Install the mobile application via the Apple App Store or Google Play Store

This license does not grant you any ownership rights in the Software.

2. Restrictions​

You may not:

  • Copy, modify, or distribute the Software or any portion thereof
  • Reverse engineer, decompile, or disassemble the Software, except to the extent expressly permitted by applicable law
  • Create derivative works based on the Software
  • Sublicense, rent, lease, or lend the Software to any third party
  • Remove or alter any proprietary notices, labels, or marks on the Software
  • Use the Software to develop a competing product or service
  • Extract or reuse any part of the source code, algorithms, or data structures

3. Intellectual Property​

The Software and all copies thereof are proprietary to the Licensor and title and all intellectual property rights therein remain with the Licensor. All rights in the Software not specifically granted in this Agreement are reserved to the Licensor.

The Software is protected by copyright laws and international treaty provisions. The Software is licensed, not sold.

4. Software Provided "As Is"​

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

5. Third-Party Services​

The Software integrates with third-party services including but not limited to:

  • Cloud hosting infrastructure
  • JetBrains IntelliJ Platform
  • Apple Push Notification service (APNs)
  • Firebase Cloud Messaging (FCM)

Your use of these third-party services is governed by their respective terms of service and privacy policies. The Licensor is not responsible for the availability, performance, or terms of third-party services.

6. Data and Privacy​

Your use of the Software is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

7. Termination​

This Agreement is effective until terminated. The Licensor may terminate this Agreement at any time if you fail to comply with any term of this Agreement. Upon termination:

  • You must cease all use of the Software
  • You must uninstall and destroy all copies of the Software in your possession
  • Sections 2, 3, 4, and 8 shall survive termination

8. Governing Law​

This Agreement shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.

9. Changes to This Agreement​

The Licensor reserves the right to modify this Agreement at any time. Changes will be effective when posted on this page with an updated "Last Updated" date. Continued use of the Software after changes constitutes acceptance of the modified Agreement.
